What Is Probate?
Probate is the legal process that confirms the will (if there is one) and gives someone the official authority to deal with the estate. In Ontario, this is called a Certificate of Appointment of Estate Trustee — and most banks, insurance companies, and real estate transactions won’t proceed without it.
When Do You Need to Apply for Probate?
You may need probate if:
- There is a will, and assets (like a home or bank account) need to be transferred
- There is no will, and someone needs authority to act
- A house or condo is part of the estate
- A bank or land registry has asked for proof of authority
Who Typically Applies?
Usually, it’s the executor named in the will. If there’s no will, it might be a spouse, adult child, or other next of kin. Either way, we’ll walk you through what’s required — and take on as much of the paperwork as you want us to.
